PERTANGGUNGJAWABAN PT. ASTRA HONDA MOTOR ATAS PRODUK CACAT TERHADAP OBJEK JUAL BELI DITINJAU DARI BUKU III KUHPERDATA jo UNDANG-UNDANG NO. 8 TAHUN 1999 TENTANG PERLINDUNGAN KONSUMEN
Economic developments in the automotive industry always increase every
year. This is proven by the market demand for motorbikes always increasing every
year. With this, every business actor and consumer who enters into a sales and
purchase agreement is required to maintain good legal relations. Business actors must
guarantee safety and security in every product distributed. The problems that will be
discussed in this research are (1) How is PT. Astra Honda Motor when a defective
product is found, (2) What are the legal consequences resulting from the defective
product issued by PT. Astra Honda Motor reviewed from Book III of the Civil Code
and UUPK, (3) How was the settlement carried out by PT. Astra Honda Motor when a
defective product is found.
In this research, the author uses research specifications with analytical
descriptive methods which aim to describe existing problems based on the theory and
practice of implementing applicable laws. The approach method used is normative
juridical which focuses on the interpretation of legal rules in positive law. The research
stage was carried out using field research and library research methods using primary,
secondary and tertiary legal materials. Data collection techniques were carried out
using document studies and interviews. The data analysis used was qualitative juridical
with the aim of reviewing all the data obtained to achieve clarity on the issues
discussed.
The results of research conducted by the author show that accountability
carried out by business actors towards consumers is an absolute thing for business
actors to carry out because this is in line with Article 1504 Book III of the Civil Code
and Article 19 paragraph (1) UUPK. The legal consequences arising from the
discovery of defective products, consumers have the right to file a claim for
compensation for breach of contract based on the agreement made by the business
actor and consumer as well as a claim for compensation for unlawful acts based on the
discovery of a defective product made by the perpetrator. business. Settlement carried
out by PT. Astra Honda Motor and MS were carried out by deliberation, with PT. Astra
Honda Motor as the business actor finally provided compensation for all losses
suffered by MS. Apart from that, to anticipate and provide legal certainty regarding
liability for defective products. PT. Astra Honda Motor adds a 5 year vehicle frame
guarantee.
