KEPASTIAN HUKUM REDISTRIBUSI TANAH NEGARA YANG DIBERIKAN KEPADA PT. QL AGROFOOD YANG BERKEDUDUKAN DI BEKASI DALAM PERSPEKTIF HUKUM AGRARIA

Land redistribution is one of a series of activities carried out by the
government in order to distribute and/or grant land rights to people who are
entitled to receive them in accordance with applicable regulations in order to create
prosperity for all Indonesian people. In implementing the redistribution of state
land former HGU Perkebunan Bojongsari CV. In Sindang Jaya, there are several
people who have not received land title certificates and there are several lands
belonging to the people of Sukamulya Village whose ownership has been
transferred to PT. QL Agrofood without the knowledge of the Sukamulya Village
community. The issues that will be discussed in this research are: What are the
provisions governing the redistribution of state land based on an agrarian law
perspective; What is the legal certainty regarding the redistribution of state land
given to PT. QL Agrofood which is domiciled in Bekasi from an agrarian law
perspective; What is the legal solution or solution to the problem of redistribution
of state land given to PT. QL Agrofood which is based in Bekasi from an agrarian
law perspective.
This research uses a research method with descriptive analytical research
specifications and a normative juridical approach method. The research stage was
carried out in two stages, namely library and field research, library research
consisting of primary legal materials, secondary legal materials and tertiary legal
materials. The data collection techniques applied were document studies and
interviews. The data collection tools used are library data collection tools and field
data collection tools. The data analysis used is qualitative juridical, which in this
research will be researched using secondary data including secondary, primary and
tertiary legal materials.
The results of this study are that the regulation regarding land
redistribution, namely Presidential Decree Number 62 of 2023, is good, but in the
implementation of land redistribution it has not complied with the regulations that
govern it, namely Presidential Decree Number 62 of 2023; in the implementation
of the redistribution of state land formerly HGU Bojongsari Plantation CV. Sindang
Jaya, there is no legal certainty for the people of Sukamulya Village who should
have the right to own the land, while PT. QL Agrofood which is domiciled in Bekasi
receives redistribution which should not have the right to receive the land
redistribution; in this case, the people of Sukamulya Village can resolve their
problems through litigation (court) or non-litigation (outside the court) in order to
provide legal certainty for the people of Sukamulya Village..
