Recent legal regulations on corrections include the protection of the
rights of mothers and children, particularly in the context of the detention
of women as prisoners, taking into account the special needs, especially
regarding children who are still in the womb. This provision is explained in
Article 1 paragraph 1 and 2 of Law No. 35 of 2014. The protection of the
rights of mothers and children in correctional institutions must be given
space and opportunities to grow and develop, such as the material needs of
mothers and children are met while the process of growth and development
together between mothers and children in correctional institutions. 1. How
is the protection of the rights of children brought by their mothers into the
Penitentiary 2. How is the implementation of the rights of children brought
by their mothers into the Penitentiary 3. How is the legal solution of the
Penitentiary in fulfilling the rights of children?
This research specifically utilizes an analytical descriptive
approach, which provides a detailed overview of relevant legal regulations
with legal principles and theories, as well as applying positive legal
practices in the context of the problem being investigated.
The conclusion of this study In Law Number 35 of 2014 concerning
Child Protection, the implementation of fulfilling the rights of children
brought by their mothers to prisons has not been fulfilled optimally, where
prisons do not follow the guidelines for the Renewal of the Implementation
of the Correctional System. The government has not consistently ensured
adequate health services for mothers and infants in prisons, such as routine
immunizations, complementary feeding, diapers, baby toiletries, and
referrals to hospitals. In addition, the provision of nutritious food and
adequate facilities for caring for infants is often not met. There is no clear
regulation regarding the protection of the fulfillment of the special rights of
children brought by prisoners to the Sukamiskin Women's Correctional
Institution in Bandung. However, the legal protection of children brought by
prisoners into prisons is also carried out by the children's rights committee,
which only focuses on children affected by the deprivation of their parents'
freedom.
