UPAYA YANG HARUS DILAKUKAN OLEH KEPALA SEKOLAH SMAN 5 KOTA SUKABUMI TERHADAP DUGAAN PEREDARAN DAN PENGGUNAAN NARKOTIKA YANG DILAKUKAN SISWA DI LINGKUNGAN SEKOLAH BERDASARKAN HUKUM INDONESIA

Drug trafficking is very rapid in Indonesia, whose users are both
from the lower classes of society with low economic income and the upper
class whose economic income is already lucrative. Drugs are drugs that are
needed by humans, for scientific purposes such as medical purposes whose
use is according to the dosage, but if the use and utilization are not in
accordance with the portion and under the control of experts in their fields
who have competence, it is an act of abuse that is threatened with criminal
sanctions and has an impact on the user's health problems and destroys the
survival of the user himself. In writing this legal current, there are problems,
including: the activities of students named Rinaldi and Bobby can be
categorized as violating Law Number 35 of 2009 concerning Narcotics and
then what legal steps and remedies can be taken by the principal of SMAN
5 Sukabumi City against students named Rinaldi and Bobby and what are
the future solutions so that the school environment of SMAN 5 Sukabumi
City is free from narcotics trafficking.
In writing this legal memorandum, the analytical tool applied is
legal interpretation or interpretation, where conclusions are obtained from
the process of interpreting the meaning contained in the legal readings used
in overcoming the cases faced concretely. This writing focuses on the laws
and regulations No. 35 of 2009 concerning Narcotics. The interpretation
analysis tools used are grammatical interpretation which is the translation
of words or terms in legislation according to the applicable legal language
rules and systematic interpretation which is the translation of laws and
regulations by relating them to other legal regulations or with the integrity
of the legal system.
Rinaldi and Bobby's actions are qualified as drug crimes so that Law
Number 35 of 2009 concerning Narcotics Article 114 paragraph (1) and its
sanctions can be applied. The procedure for submitting a report of narotical
crimes can be done in two ways, namely by reporting directly and reporting
indirectly by entering the website of the National Narcotics Agency in
https://bnn.go.id/satuan-kerja/ittama/pengaduan/ and can contact the
police by calling 110. The solution so that the school environment is free
from narcotics is that schools need to form an anti-drug network, as well as
provide effective learning about the dangers of narcotics, forming an Anti-
Drug Movement Program. The school responds to this case if it is repeated,
it will immediately hand it over to the authorities to be handled by the
authorities directly.
