KEPASTIAN HUKUM STATUS KEPEMILIKAN TANAH TIMBUL DALAM PROGRAM REFORMA AGRARIA (TORA) BAGI MASYARAKAT DI WILAYAH LAUT DESA PATIMBAN KABUPATEN SUBANG DIHUBUNGKAN DENGAN PERATURAN PRESIDEN NOMOR 62 TAHUN 2023 TENTANG PERCEPATAN PELAKSANAAN REFORMA AGRARIA

The Agrarian Reform Program is one of the important efforts in improving the
welfare of rural communities, especially in terms of land ownership. In Patimban
Village, Subang Regency, the implementation of the agrarian reform program,
especially the Land for Agrarian Reform Objects (TORA) Program related to
arising land, is a major concern. This research aims to analyze the certainty of land
object ownership status in the TORA program and its relation to Presidential
Regulation Number 62 of 2023 concerning the Acceleration of Agrarian Reform
Implementation.
This research uses descriptive analytical research specifications, namely describing
the applicable laws and regulations associated with legal theories. The research
approach method is normative juridical, which is an approach that refers to the
rules of law. The research stage includes library research with three research legal
materials such as primary, secondary and tertiary which are relevant to this
research, field research by conducting interviews directly with the Indebted Party.
Data collection techniques with document studies and interviews. This research
data analysis uses qualitative juridical.
The results showed that although Presidential Regulation No. 62 of 2023 on the
Acceleration of Agrarian Reform Implementation provides a clear legal basis for
accelerating the implementation of agrarian reform, in practice there are still
several challenges related to the certainty of land ownership status for the
community in Patimban Village. Factors such as Subjects, Agrarian Reform Land
Objects, uncertainty of land legality are still the main obstacles. This research
provides an important contribution in understanding the implementation of the
TORA Program and the relevance of the Presidential Regulation in the context of
agrarian reform at the local level. The implication of this research is expected to be
an input for related parties in improving the effectiveness of agrarian reform
implementation, especially in the sea area of Patimban Village, Subang Regency.
